General terms and conditions of business
By booking the unit via our website, the guest agrees to these terms and house rules:
- MAXIMUM NUMBER OF GUESTS & SUBLETTING: The accommodation is rented only to the persons named in the booking. Subletting the apartment is not permitted. Please note that the daily rental rate for this accommodation is for a maximum of 5 people (Casa Capricorn) or 6 people (Casa Tschierva), with the 5th and 6th person being charged extra. Please indicate the full number of guests when booking. Failure to comply with this rule will result in immediate eviction.
- ONLINE CHECK-IN BEFORE ARRIVAL: You must check in online at least 24 hours before your arrival. As the lead guest, you will be asked by the host to provide your digital ID or a copy of your passport, your home address, and the names, first names, and dates of birth of all guests. Once you have checked in online, you will receive the code for the key safe and further information for your stay.
- CANCELLATION POLICY: Guests can cancel free of charge up to 30 days before arrival and the full amount will be refunded to their credit card. For cancellations made within 30 days of arrival, the guest will be charged the full price of the reservation. In the event of a no-show, the guest will also be charged the full price of the reservation.
- GUEST TAX: Local legislation stipulates a visitor's tax (CHF 5.9 per person over 12 years of age per day). Upon payment of the visitor's tax, you and your guests will receive a non-transferable guest card, which offers various benefits, such as free use of public transport in the Davos Klosters region. This visitor's tax is not included in the price and will not be collected by the host. You can pay for and collect the guest card directly at the "Destination Davos Klosters" upon your arrival.
- NO SMOKING: This is a non-smoking rental unit. Smoking is not permitted anywhere in the rental property.
- KEYS: The landlord will provide the guest with the keys in a key safe at the apartment entrance. The guest is required to return all keys upon departure and ensure they are placed back in the key safe. Instructions regarding the keys will be sent to the guest before arrival.
- USE: The guest may only use the property as a private residence. The guest may not use the property for commercial, illegal, or unauthorized purposes. No alterations may be made to the property. The guest warrants that all appliances and furniture will be used only for their intended purpose. The guest confirms that they are over 18 years of age and that minors will only occupy the property in the presence of an adult. Unreasonable noise or disturbance caused by the guest may result in the termination of the contract. The guest is solely responsible for disposing of their trash in the provided bin.
- EVENTS AND CELEBRATIONS: are not allowed in the accommodation and in the communal garden.
- SHOES: We kindly ask you to remove your shoes at the entrance and wear slippers inside the accommodation.
- SKIS AND SKI BOOTS: Please do not leave skis or ski boots in the apartment – not even in the hallway! Please leave your skis either outside the apartment on the lockable ski rack (black key) or in the ski room (black key). Leave your ski boots in the ski storage room. Wearing ski boots inside the accommodation is prohibited.
- BARBECUELING: The wood-fired grill in the communal garden belongs to the owners' association and may be used in moderation, provided everything is left clean and tidy (ashes must be disposed of in the metal container, and the tongs and grill grate must be cleaned). You should also bring your own firewood.
- PETS: No pets are allowed in the apartment. Guests are obliged to follow this and all other rules of the owner to ensure the safety and cleanliness of the property and not to disturb or endanger other tenants.
- OWNER'S DISCLAIMER: This agreement is based on the guest's independent knowledge of the property or the representations contained in this agreement, and not on representations made by the owner or their representatives. The owner is not liable for any damage or injury caused to the guest, their family, guests, agents, or any other person entering the premises or the building to which the premises belong. The guest hereby agrees to indemnify and hold harmless the owner from all claims of any kind. The owner is not responsible for the loss of the guest's personal belongings or valuables. It is expressly agreed that all guests assume the risk of damage caused by their own use of the premises or by others they invite to use the premises.
- ACCEPTANCE OF THE PROPERTY: Opinions regarding the condition of the property can vary from person to person and are highly subjective. If the guest has not personally viewed or inspected the property, they may not rely on the opinions of third parties, including the owner or their representative. The guest assumes sole risk if they rent the property without viewing it and are not satisfied with its condition at the time of check-in. The guest has not been promised anything regarding the condition of the property unless explicitly stated in this contract. The property is rented "as is."
- PARKING: Private parking is available in the garage, but at the guest's own risk. The owner is not responsible for any damage to the guest's vehicle. The guest is liable for all damage that occurs in the garage or to adjacent parked vehicles. The guest may also park their vehicle in the guest parking area, but at their own risk.
- END OF LEASE AND SECURITY DEPOSIT: The guest agrees to return the property to the owner in the same clean and good condition as at the beginning of this lease, apart from normal wear and tear from reasonable use. The guest is responsible for the costs of maintenance and repairs if the premises are in a worse condition than before their arrival. Furthermore, the guest agrees to repair, replace, or pay for the repair or replacement of any damage to the property, furnishings, and equipment. The guest agrees that these costs or other amounts owed will be deducted from the security deposit. A violation of the rules regarding smoking, events, and/or pets will result in the forfeiture of the entire security deposit. The security deposit may be automatically refunded ten (10) days after the termination of this lease, unless the owner determines that damages or other deductions are due to the guest's actions. These amounts will be deducted from the security deposit, and the remaining balance will be refunded. If the amounts due exceed the deposit, the guest is liable for these amounts.
- ACCESS TO THE PROPERTY: The owner or their representative must be granted access to the property at any time to inspect it, carry out necessary repairs, alterations, or improvements, perform necessary services, and show the property to potential buyers, tenants, etc. The owner will exercise this right of access in a reasonable manner.
- CONTRACT AND WAIVER OF THE GUEST: This contract becomes effective upon booking and may be terminated by the owner in the event of late payment, false information, or other breach of the guest's obligations as described in this contract. The guest agrees to bear all reasonable costs, legal fees, and expenses incurred by the owner in enforcing this contract.
- AMENITIES: The landlord provides bed linen and towels. If the guest wishes to bring their own bed linen, they can request a reduction in the cleaning fee. The landlord provides basic appliances and furniture. However, no warranty is given for the appliances, and repairs or replacements will be carried out as soon as possible. High-speed internet and cable TV are provided as a courtesy only and are not part of the agreement. There are no refunds for outages, content, missing content, network speed, access problems, lack of knowledge about usage, or personal preferences regarding cable or internet.
- RENTABILITY: If the premises are destroyed by fire, other accidents, or force majeure, rendering them uninhabitable either before or during the term of the lease, the owner will refund a reasonable, pro-rata portion of the rent paid in advance. The lease will not terminate due to circumstances outside the building or within the property that are beyond the owner's control, or due to malfunctioning appliances in the apartment. There are no refunds or discounts for malfunctioning appliances or defective equipment, adverse weather, early departure, interruption of utilities, construction work in the area, or maintenance issues. All tenants are advised to purchase travel insurance.
- DANGEROUS MATERIALS, FIREARMS, AND ILLEGAL SUBSTANCES: Guests may not store or possess any dangerous, flammable, or explosive items in the apartment that could unreasonably increase the risk of fire or explosion or that could be classified as hazardous materials (including propane) by a competent insurance company. Fireworks of any kind are not permitted in the apartment. Firearms and illegal substances are also not permitted in the apartment.
- LEFT-OFF ITEMS: The landlord does not store items left behind by the guest. Personal belongings of the guest left behind after the end of the contract will be considered rubbish and removed by the cleaning team to prepare the unit for arriving guests. Every reasonable effort will be made to send valuable items found by another guest or the cleaning team to the guest, but no guarantee is given.
- AMENDMENT: The parties hereby agree that this document contains the entire agreement between the parties and that this agreement may not be modified, altered, changed or supplemented in any way except by a written amendment signed by all parties.
